БЕЛЫЙ ДОМ И КАПИТОЛИЙ: БИТВА ЗА ВЕРХОВНЫЙ СУД (ВТОРАЯ ПОЛОВИНА XX ВЕКА)

Назначение судей Верховного суда США осуществляется президентом, но кандидатуры судей подлежат утверждению Сенатом. Это требование Конституции создает условия для постоянной борьбы и соперничества между главой исполнительной власти и сенаторами. В статье рассматривается история политической борьбы между исполнительной властью и Сенатом в США за формирование состава суда во второй половине XX в. Очевидно, что возможность отдавать предпочтение «партийным кандидатам» на должность судей возникала у тех президентов, которые могли опираться на большинство своих однопартийцев в Сенате. В этом случае назначение предлагаемых президентом судей проходило без особых проблем. В XX в. в 46 случаях из 62 представлений кандидатов на должность судей президенты имели дело с большинством сторонников своей партии в Сенате. В условиях разделенного правления (президент и Сенат – из разных партий) приходилось наибольшее число отклоненных кандидатур – в пяти случаях. Тем не менее даже наличие большинства у президентской партии не всегда гарантировало успех. Статья охватывает период второй половины XX в., поскольку именно в это время президентская политика и политика партий по вопросу формирования состава Верховного суда обрела четкую направленность. Наибольшее внимание уделяется анализу политических мотивов, которыми руководствовались президенты и сенаторы в процессе обсуждения кандидатур на должности судей. Анализируются концептуальные подходы администраций Никсона, Рейгана, Клинтона к вопросу выработки критериев для выбора судей.Библиографические ссылки
